These Terms of Service ("Terms") govern your use of mrigart.com (the "Site") and every purchase you make on it. By using the Site or placing an order, you agree to these Terms.

1. About us

1.1 The Site is operated by Anurag Chauhan, sole proprietor, trading as MrigArt ("MrigArt", "we", "us" or "our").

1.2 The Site is hosted on Shopify. Payments are processed by third-party payment gateways, and products are produced and delivered through our printing and fulfilment partners.

2. Eligibility

2.1 You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872 to place an order. A person under 18 may use the Site only under the supervision of a parent or legal guardian, who accepts these Terms on their behalf.

3. Our products

3.1 MrigArt sells printed reproductions of classical and folk artworks that are in the public domain, offered as framed posters, canvas prints, apparel and accessories. These are reproductions, not original artworks.

3.2 Our artwork files are digitally restored from vintage reproductions using AI-assisted restoration tools, with care taken to preserve the original detail and colour of each artist's work.

3.3 We take care to display products accurately. However, colours on screen depend on your device, and lifestyle or room images are illustrative. Product dimensions are approximate and subject to normal manufacturing tolerances.

3.4 Artwork titles, artist attributions and dates are given in good faith, based on museum and archival sources. They are provided for information and do not form a guarantee of provenance.

4. Orders

4.1 Placing an order is an offer to purchase. A binding contract is formed when we confirm your order by email.

4.2 We may refuse or cancel any order before dispatch, including for a pricing or listing error, unavailability of materials, payment failure, suspected fraud or an undeliverable address. In such cases we will refund the full amount paid, with no charge to you.

4.3 Cancellations, returns and refunds are governed by our Return and Refund Policy, which forms part of these Terms.

5. Prices and payment

5.1 All prices are in Indian Rupees (INR) and include applicable taxes, including GST. Delivery within India is free, as set out in our Shipping Policy.

5.2 Prices may change without notice. The price that applies is the one shown when you place your order.

5.3 Payment is made through secure third-party payment gateways, such as Razorpay, by card, UPI, net banking, wallet or any other method shown at checkout. We do not store your card or bank details.

5.4 Cash on Delivery, where offered, may carry an additional fee shown at checkout.

6. Shipping, title and risk

6.1 Delivery is governed by our Shipping Policy, which forms part of these Terms.

6.2 Ownership of and risk in the products pass to you on delivery.

7. Intellectual property

7.1 The original artworks reproduced on our products are in the public domain.

7.2 All other content on the Site belongs to MrigArt or its licensors, to the extent protected by law. This includes our restored artwork files, product designs, photographs, mockups, text, graphics, the MrigArt name and logo, and the selection and arrangement of this content.

7.3 You may not copy, reproduce, download, scrape, sell or otherwise use any such content for commercial purposes without our prior written consent.

8. Use of the Site

8.1 You agree not to:

  • (a) use the Site for any unlawful or fraudulent purpose;
  • (b) provide false, inaccurate or another person's information;
  • (c) interfere with the Site's security or operation, or introduce malicious code;
  • (d) use automated tools to extract content or data from the Site; or
  • (e) post content that is defamatory, obscene, infringing or otherwise unlawful.

8.2 If you submit reviews, photos or other content, you grant MrigArt a non-exclusive, royalty-free, perpetual licence to use, reproduce and display it in connection with our business. You confirm that you have the right to grant this licence.

9.1 The Site may link to or rely on third-party services, such as payment gateways, couriers and social media platforms. Their terms and privacy policies govern your use of them, and we are not responsible for their content or practices.

10. Disclaimer

10.1 Except as expressly stated in these Terms and our policies, and to the extent permitted by law, the Site and products are provided "as is" and "as available", without warranties of any kind.

11. Limitation of liability

11.1 To the fullest extent permitted by law, MrigArt is not liable for any indirect, incidental, special or consequential loss arising from your use of the Site or our products.

11.2 Our total liability for any claim relating to an order is limited to the amount you paid for that order.

11.3 Nothing in these Terms excludes or limits any liability that cannot be excluded under applicable law, including your rights under the Consumer Protection Act, 2019.

12. Indemnity

12.1 You agree to indemnify MrigArt against any claims, losses and expenses arising from your breach of these Terms or your misuse of the Site.

13. Force majeure

13.1 We are not liable for any delay or failure to perform caused by events beyond our reasonable control. These include natural disasters, epidemics, government action, strikes, courier disruptions and failures of telecommunications or utilities.

14. Privacy

14.1 Our collection and use of your personal data are governed by our Privacy Policy.

15. Grievance redressal

15.1 Complaints may be sent to our Grievance Officer, whose details are given in our Contact Information.

15.2 We will acknowledge every complaint within 48 hours of receipt and resolve it within one month, in line with the Consumer Protection (E-Commerce) Rules, 2020.

16. Governing law and jurisdiction

16.1 These Terms are governed by the laws of India.

16.2 Subject to your right to approach any Consumer Commission under the Consumer Protection Act, 2019, the courts at Delhi have exclusive jurisdiction over any dispute arising from these Terms.

17. Changes to these Terms

17.1 We may update these Terms from time to time. Changes take effect when posted on the Site and apply to orders placed after that date.

18. General

18.1 If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force.

18.2 Our failure to enforce any right does not waive that right.

18.3 These Terms, together with our Return and Refund Policy, Shipping Policy and Privacy Policy, form the entire agreement between you and MrigArt regarding your use of the Site.
